On September 13, 2022, I contracted with a representative (Robert) of RTS All American Garage Door Company to replace my garage door. As evidenced by the attached, a deposit in the amount of one-thousand-six-hundred and eighty ($1680.00) dollars was made pursuant to this contract.
The original garage door requested was to have windows at the top of the door. After numerous calls during the month of October, 2022, in November I was advised by the receptionist, as per Robert, that the delay was the result of pandemic manufacturing supply chain issues of the windowed garage doors. Due to travel, the holidays, and other personal issues, no attempt was made to contact RTS until the latter weeks of January 2023.
On many occasions during the months that have followed, up to this present time, I have attempted to contact RTS by phone leaving numerous voice mail messages and have received very few if any responses. On the rare times that the receptionist has answered the phone, or returned one of my calls, I have requested that Robert contact me directly, to no avail.
Since the reason given for the delay was the windows in the garage door, on or about March 14, 2023, I was able to speak with the receptionist and advise her that I would be willing to accept a garage door without windows. I further stated that I would expect this change to be reflected in the contract and she stated that the change would result in a savings of two-hundred ($200.00) dollars.
Based on RTS’s failure to reasonably fulfill our contractual agreement, I submit that my contract with RTS is terminated, and request the deposit of one-thousand-six-hundred-and-eighty ($1680.00) dollars be returned not later than June 1, 2023.
